Pool rules and membership agreement

This is what every key holder agrees to when they buy a season key. It's also posted at the pool. Version 2026-2.

Read carefully

The pool is not a public facility; swimming is at your own risk. The pool is not staffed and does not provide any supervision. All risk of faecal contamination must be avoided, if the pool is not to be closed for emptying and refilling. Safety is paramount. For these reasons, the following conditions and rules of membership apply:

  • Always ensure that the door is kept closed and locked. Double check when leaving.
  • Children under 14 must be actively supervised by a person aged 18 or over at all times. Actively supervised means watching your child at all times and being able to provide immediate assistance. Children 14 and over may attend without supervision but may not supervise others unless aged 18 or over.
  • Children who are not fully toilet trained must wear a swim nappy.
  • Please do not use the pool if you have had diarrhoea in the past fortnight. Do not enter the pool if farm dirty.
  • Users of the pool are required to be members. Members may take guests; guests must each pay $2.00 and may attend and leave only with their host member. Do not admit non-key holders. Any non-key holder you admit is your guest and your responsibility.
  • No key copying or misuse. Serious or persistent breach of rules may result in revocation of membership.

Summary of rules

  • Caregivers MUST actively supervise children under 14.
  • Entry door must be kept closed.
  • Swim with care. Be considerate of others.
  • BOTH pool covers must be carefully removed before swimming.
  • No alcohol, no glass, no smoking or vaping, no animals, no swearing.
  • No diving for stones, keys or other sharp or heavy items.
  • Clean swimwear must be worn. No street or farm clothing.
  • Only those able to swim 2 lengths are to use the deep end.
  • Cust School has priority. The pool is closed to members when Cust School is present (9 to 3 during term time).
  • No jumping off the covers.
  • No swimming after dark.

Membership agreement and release of liability

Cust Community Swimming Pool Inc. (the "Society"). This agreement is made between the applicant ("the Member") and the Society for membership and use of the pool facility for the 2026/27 season. This is a legal and binding agreement.

1. Acknowledgement of risk and release of liability. 1.1 The Member acknowledges that the Society's swimming pool is an unstaffed and unsupervised facility. Use of the pool is entirely at your own risk. 1.2 The Member fully understands and accepts all risks associated with swimming, including but not limited to the risk of drowning, injury, loss, or property damage arising from any cause whatsoever, including the negligence of the Society, its officers, or committee members. 1.3 The Member agrees that the Society, its committee members, agents, and volunteers are not liable for any injury, loss, or damage to any person or property, regardless of how it is caused. 1.4 The Member indemnifies and holds harmless the Society, its committee members, and agents against any and all claims, demands, or legal proceedings arising from the use of the pool by the Member or their guests.

2. Membership and guest policy. 2.1 All persons using the pool facility must be members of the Society, unless they are a properly registered guest. 2.2 A member may bring guests to the pool, provided the guest fee of $2.00 per person is paid. 2.3 Guests must be accompanied by the host member at all times and leave with them. 2.4 A Member is fully and solely responsible for the behaviour and safety of their guests. The guest fee does not provide any form of insurance or waiver of liability.

3. Pool rules and code of conduct. 3.1 Security: the main gate must be kept closed and locked at all times. The Member is responsible for ensuring the gate is locked upon entry and exit. 3.2 Supervision: children under 14 years must be actively supervised by a person 18 years or older, who must be in the immediate pool area at all times. Children 14 and older may attend unsupervised but cannot supervise others. 3.3 Hygiene: all persons must shower before entering the pool; children who are not toilet-trained must wear a swim nappy to prevent contamination; do not enter the pool if you have had diarrhoea in the past fortnight. 3.4 Safety: no running, pushing, or rough play on the pool deck or in the pool; no glass, alcohol, or smoking/vaping anywhere within the pool fence; no diving in the shallow end, competent swimmers only in the deep end; the pool covers must be carefully removed and replaced by members; no animals inside the pool fence; swimming is not permitted after dark. 3.5 Cust School priority: the pool is closed to members during any scheduled Cust School session.

4. Breach of rules. 4.1 Any serious or persistent breach of these rules may result in membership suspension or revocation at the discretion of the Committee. 4.2 Members are responsible for their own conduct and that of their children and guests. Any non-compliance will be addressed with the Member.

5. Membership fees. 5.1 Membership fees are payable in full at the time of application. Membership is not active, and a key will not be issued, until payment has been received.

6. Emergencies and first aid. 6.1 In the event of a medical emergency, dial 111. 6.2 A first aid kit is located next to the filter house. All accidents or injuries must be reported to a committee member. 6.3 All users must immediately exit the pool at the first sign of a thunderstorm.

7. Membership agreement. By completing and submitting the membership form, I agree to be bound by the rules and conditions contained in this document. I also acknowledge that I have read and understood this entire document.

8. The Society's constitution. Membership of the pool is membership of Cust Community Swimming Pool Inc., an incorporated society. The Society's constitution governs how members are admitted, how conduct and disputes are handled, the duties of officers and how the Society reports on its finances. A copy is available from the Secretary on request.

9. Amendment of rules and terms of membership. The Society reserves the right to amend the Pool Rules and these Terms of Membership. Any amendment will be made in accordance with the Society's Constitution and the Incorporated Societies Act 2022. For any material changes, members will be notified in writing, and any member unhappy with the change may resign their membership.
